1. Scope of Application

2. Subject of the Contract
We offer digital products (e.g., PDF guides, workout/nutrition plans, fasting guides) and online access via our platform.
We do not sell physical goods.
In the future, we may offer subscription-based memberships.

3. Conclusion of Contract
The product listings on our website are non-binding and serve as an invitation to order.

• A binding contract is formed when you complete the checkout process and receive access to the purchased product.

• All sales are processed via CopeCart GmbH, acting as the Merchant of Record.

• The sales contract is concluded with CopeCart for billing and transaction purposes.

4. Prices and Payment

• All prices are shown in EUR (Euro).
  We do not charge VAT under § 19 of the German VAT Act (small business regulation).

• Payment options include methods available through CopeCart (e.g., credit card, PayPal, Apple Pay).

• Access to digital products is granted only after full payment has been received.

5. Right of Withdrawal

• Consumers have a statutory right of withdrawal under § 355 BGB.

• However, for digital content not delivered on a physical medium, this right expires once performance has begun and the customer has expressly agreed to this in advance.

• The customer expressly agrees that the execution of the contract begins before the expiry of the withdrawal period, and acknowledges that the right of withdrawal is lost once performance has begun in accordance with § 356(5) BGB.

• This waiver is part of the checkout process and must be actively confirmed by the customer.

6. Subscriptions and Memberships
Should we offer subscriptions (e.g., community access), the agreed subscription terms at the time of purchase apply.

• Subscriptions automatically renew unless canceled on time.

• Cancellation must be made before the renewal date to avoid charges for the next billing period.

• Cancellations can be sent to richard.tysn@icloud.com.

• No refunds are given for ongoing billing cycles after cancellation.

7. Copyright and License

• All content provided by us (e.g., PDFs, templates, videos, documents) is protected by copyright.

• You receive a non-transferable, non-exclusive license for personal use only.

• Redistribution, resale, or public sharing is strictly prohibited without prior written consent.

• Legal steps and claims for damages may be pursued in the event of violations.

8. Liability

• We are fully liable for intent and gross negligence.

• For slight negligence, we are only liable for breach of essential obligations (cardinal duties).

• In such cases, liability is limited to foreseeable, typical damages.

• We are not liable for lost profits or consequential damages.

• These limitations also apply to agents and representatives.

We ensure appropriate safeguards are in place for all such transfers.

9. Warranty
Legal warranty rights apply.
Digital products must match their description and be free of defects.

10. Data Protection
Personal data is processed in accordance with our Privacy Policy.

11. Applicable Law and Jurisdiction

• These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

• If you are a merchant or a legal entity, or have no residence in Germany, the place of jurisdiction is Germany.

12. Severability Clause
If any provision of these Terms is invalid, the remaining provisions remain unaffected.
